TERMS OF SERVICE
OVERVIEW
This website is operated by Timber Linings. Throughout these Terms, “Timber Linings”, “we”, “us” and “our” refer to Timber Linings.
These Terms of Service apply when you visit our website, use our online services or purchase products from us. By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

WEBSITE ACCESS AND ACCOUNTS
You must provide accurate, current and complete information when creating an account or placing an order.
You are responsible for keeping your account credentials secure and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without permission.
You must not use our website or services for any unlawful, fraudulent or unauthorised purpose.

PRODUCT INFORMATION
We make reasonable efforts to ensure product descriptions, specifications, images, prices and availability information are accurate.
Images are provided as a general representation. Colours and appearance may vary because of lighting, photography, screen settings and the natural characteristics of timber.
Timber is a natural material. Colour, grain, figure, knots and other characteristics can vary between boards, packs, samples and production batches. Samples indicate the general species, profile and finish but cannot represent every natural variation that may appear in a completed order.
Product specifications may be updated where reasonably necessary. Any material change affecting an accepted order will be communicated to you.

MEASUREMENTS, PACKS AND CALCULATORS
Products may be sold by individual unit, pack length, lineal metre or another unit stated on the relevant product page.
Where products are supplied in complete packs, packs cannot be split unless expressly stated. An order may therefore supply slightly more lineal metres than the calculated requirement.
Any product calculator, coverage figure, wastage allowance or quantity recommendation on our website is an estimate based on the information entered and the published product dimensions. Project requirements can vary because of room dimensions, installation direction, cutting, joins, site conditions and workmanship.
You are responsible for checking measurements and quantities before ordering. We recommend confirming requirements with your builder, carpenter, designer or installer where appropriate.

PRODUCT SUITABILITY AND INSTALLATION
You are responsible for confirming that a product is suitable for its intended location, application and environmental conditions before ordering and installation.
Products must be stored, handled, acclimatised, prepared, finished and installed in accordance with the applicable product information, installation instructions, manufacturer guidance and relevant building requirements.
Only products expressly described as suitable for exterior use should be installed externally. References to fire, bushfire, acoustic, durability or performance characteristics apply only as stated in the applicable product documentation and subject to any specified installation requirements.
General information provided through our website, calculators, samples, email, telephone or chat does not replace project-specific advice from a suitably qualified professional.
Please inspect all products before cutting, coating or installation. If you believe a product is damaged, faulty, incorrect or materially different from its description, contact us before proceeding where reasonably possible.

ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase the products in your cart.
After receiving your order, we will send an electronic acknowledgement. An order is accepted when we confirm it for processing, subject to successful payment and product availability.
Please review product type, species, profile, finish, length, quantity, delivery address and contact details carefully before submitting your order.
Contact us promptly if you need to request a change or cancellation. We cannot guarantee that an order can be changed or cancelled after picking, packing, production or freight arrangements have commenced.
If we cannot accept or fulfil an order, we will contact you and provide an appropriate remedy, which may include a refund.

STOCK AND INCOMING SHIPMENTS
Availability displayed on our website may include products currently held at our warehouse and products allocated from an incoming shipment.
Where an order includes incoming stock, the website may display an estimated dispatch date. This date is an estimate based on the information available from our suppliers and freight providers and may change because of manufacturing, shipping, customs, quarantine or transport delays.
Unless otherwise agreed, an order containing both available and incoming products will be dispatched when the complete order is ready. We do not automatically provide split or partial deliveries.
If an expected delay materially affects your order, we will contact you to discuss the available options and your rights under applicable law.

PRICES AND PAYMENT
Prices are displayed in Australian dollars and include GST where applicable, unless expressly stated otherwise.
Delivery, freight or other charges are shown separately during checkout where applicable.
Prices, discounts and promotions may change without notice. The price applying to an accepted order is the price shown at checkout and in the order confirmation, except where an obvious error has occurred.
If we identify a material pricing or product-information error before fulfilment, we will contact you and give you the option to proceed with the corrected information or cancel the affected product for a refund.
You must provide valid and authorised payment information. Payment processing may be provided by Shopify or another third-party payment provider and may be subject to that provider’s terms.

SHIPPING, DELIVERY AND COLLECTION
Orders are supplied in accordance with our Shipping Policy and the delivery or collection method selected at checkout.
Delivery and dispatch timeframes are estimates unless we expressly agree otherwise. We will take reasonable steps to meet estimated timeframes and communicate material delays.
Freight options may include warehouse pickup, carrier-depot collection, residential delivery, or business and site delivery. Availability depends on the products, destination and carrier coverage.
For depot collection, you are responsible for collecting the order from the nominated depot during its operating hours and within any timeframe advised by the carrier.
For residential, business or site delivery, you must provide accurate access information and ensure a responsible person is available to receive the order. Long or heavy timber products may require suitable unloading assistance or equipment, including a forklift where advised.
Additional carrier charges caused by incorrect delivery information, unsuccessful delivery, restricted access, delayed collection or unavailable unloading arrangements may be payable by you where those charges were reasonably avoidable and disclosed or communicated.
Risk in the products passes to you when the products are delivered to the nominated address or handed over to you or your representative at our warehouse or the nominated collection depot.
Please inspect the shipment promptly. Where visible freight damage exists, note it with the carrier where possible and take photographs before unpacking. Contact us as soon as reasonably possible so we can assist.
Nothing in this section limits your rights under the Australian Consumer Law.

RETURNS, REFUNDS AND CONSUMER GUARANTEES
Change-of-mind returns are governed by our Return and Refund Policy.
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances.
The voluntary timeframes and conditions applying to change-of-mind returns do not limit your rights concerning faulty, damaged, unsafe, misdescribed or otherwise non-compliant products.

INTELLECTUAL PROPERTY
Unless otherwise stated, the website and its content—including text, product descriptions, photographs, graphics, logos, videos, design elements and downloadable material—are owned by or licensed to Timber Linings and are protected by applicable intellectual property laws.
You may view and use the website for personal or legitimate business purchasing purposes. You must not reproduce, republish, modify, distribute, commercially exploit or create derivative works from our content without prior written permission, except where permitted by law.

Our website may provide access to third-party services, tools, applications or links, including payment providers, review platforms, freight carriers and tracking services.

RELATIONSHIP WITH SHOPIFY
Timber Linings is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Timber Linings.
By using the Services, you acknowledge that Shopify is not the seller of products purchased from Timber Linings and is not responsible for fulfilling your order. Nothing in this section limits any rights you may have against Timber Linings under applicable law.

PRIVACY
Personal information collected through our website is handled in accordance with our Privacy Policy, available through the website footer.
Because our store is hosted by Shopify, Shopify and other service providers may process personal information to operate the website, process transactions, prevent fraud and provide related services. Further information is provided in our Privacy Policy and Shopify’s applicable privacy policy.

REVIEWS, PHOTOGRAPHS AND FEEDBACK
If you submit a review, photograph, suggestion or other content, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.
You grant Timber Linings a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting our business and products.
We may moderate or remove content that is unlawful, misleading, abusive, offensive, irrelevant or infringes another person’s rights.

ERRORS AND AVAILABILITY
Occasionally, website information may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, freight charges or estimated timeframes.
We may correct or update inaccurate information. If an error materially affects an order you have placed, we will contact you and provide reasonable options consistent with applicable law.
We may limit quantities or discontinue products where reasonably necessary.

Where liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law.

TERMINATION
We may suspend or terminate access to the website if you materially breach these Terms, misuse the website or engage in unlawful or fraudulent conduct.
Any provisions that are intended by their nature to continue after termination will remain in effect.

SEVERABILITY
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be severed or limited to the minimum extent necessary. The remaining provisions will continue to apply.

ENTIRE AGREEMENT AND WAIVER
These Terms and the policies referenced in them form the agreement between you and Timber Linings concerning use of the website and purchases through it.
A failure or delay in enforcing a provision does not waive our right to enforce it later.

GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the courts of New South Wales and any courts entitled to hear appeals from them, subject to any rights a consumer may have under applicable law.

We may update these Terms by publishing a revised version on our website.
Changes apply from the date they are published and do not retrospectively alter an order already accepted, unless required by law or agreed with you.
